How do you qualify for the Physician NIW as a doctor?
The Physician NIW has its own statutory framework that differs from regular EB-2 NIW. Generally speaking, you must work full-time in clinical medicine, in a designated underserved area or at a VA facility, for an aggregate of five years.
Core USCIS criteria
5 YEARS FULL-TIME SERVICE REQUIRED
Full-time clinical practice
You must work full-time in direct patient care, at least 40 hours per week. Research-only or administrative-only roles do not qualify, even at the same institution.
Qualifying location
A Health Professional Shortage Area, Medically Underserved Area, Mental Health HPSA, or a VA facility. The designation must be valid when your employment begins. If the area loses its designation after you start, your time there still counts as long as all other requirements are met.
Five years aggregate service
Five years of qualifying employment, which can be spread across multiple facilities. Prior service counts, including time worked before filing, as long as it was performed under a qualifying nonimmigrant status. Time served while in J-1 status itself does not count toward the five years.
Attestation from a state department of health or the VA
A formal letter confirming that your work serves the public interest, signed by the appropriate state or federal official. This is the document USCIS keys on.
Underlying EB-2 qualification
You must hold a medical degree, have passed the USMLE, and demonstrate English proficiency through ECFMG certification. Dentists, chiropractors, podiatrists, and optometrists do not qualify.
What strong evidence looks like for physicians
Employment contract showing start date, hours per week, and location of practice — dated within 6 months of filing if work has not yet started.
HPSA or MUA designation documentation from HRSA confirming the location was designated when employment began.
Attestation letter from the state department of health or a federal agency confirming the work is in the public interest — also dated within 6 months of filing if work has not yet started.
USMLE passage and ECFMG certification (for foreign-trained physicians) demonstrating medical qualifications and English proficiency.
If you worked at multiple facilities, documentation covering each period of service separately.
Pay stubs or employer letters confirming full-time clinical hours, where applicable.
