Do I need an immigration lawyer to apply for the EB-1 visa?
You are not required to hire a lawyer, but the EB-1 is one of the most challenging Green Cards to win because the standard is so high and the evidence must be carefully organized. Many applicants meet the criteria but struggle to present their achievements in a way USCIS finds persuasive. An experienced EB-1 visa lawyer can help you identify the strongest evidence, frame your accomplishments effectively, and avoid costly mistakes that could lead to delays or denials. For most people, the difference between “almost qualified” and “approved” comes down to strategy and presentation.
What’s the difference between EB-1, EB-2, and EB-3?
The main differences are in eligibility, requirements, and wait times: - EB-1: For individuals at the top of their field, such as people with extraordinary ability, outstanding professors/researchers, or multinational executives. It has the highest bar to qualify but often the shortest wait times. - EB-2: For professionals with advanced degrees or exceptional ability in their field. Some applicants may qualify for a National Interest Waiver (NIW), which allows them to self-petition without an employer sponsor. - EB-3: For skilled workers (2+ years of experience), professionals with a bachelor’s degree, and other workers performing unskilled labor. It has broader eligibility but often longer wait times due to higher demand. All three lead to a Green Card and eventual citizenship. The best category for you depends on your qualifications, career level, and whether you have a sponsoring employer.
What are the EB-1A eligibility criteria?
To qualify under EB-1A (Extraordinary Ability), you must show sustained national or international acclaim by meeting at least 3 of the 10 official USCIS criteria (or by winning a major award like a Nobel Prize, Oscar, or Olympic medal): - Evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence in your field. - Evidence of membership in associations that require outstanding achievement of their members, judged by recognized experts. - Evidence of published material about you in major media or professional publications. - Evidence of having judged the work of others, either individually or on a panel. Evidence of original contributions of major significance to your field. - Evidence of authorship of scholarly articles in professional or major trade publications or media. - Evidence of your work being displayed at artistic exhibitions or showcases. Evidence of having played a leading or critical role in distinguished organizations. Evidence of commanding a high salary or significantly higher pay than others in your field. - Evidence of commercial success in the performing arts (box office receipts, record sales, etc.). NOTE: Even if you meet three criteria, USCIS also applies a “final merits determination.” This involves looking at your case holistically to confirm that your achievements place you among the small percentage at the very top of your field.
If I already have an O-1 visa, does that mean I qualify for EB-1A?
Not automatically, but it’s a strong indicator you may be close. Both visas require extraordinary ability, but the EB-1 is a permanent worker visa while the O-1 is for temporary workers. Many O-1 holders transition successfully by showing continued recognition, new awards, or broader impact since their O-1 approval. If you have an O-1, it’s worth speaking to an EB-1 visa lawyer to see whether your case is EB-1A ready now or needs further strengthening.
What are the EB-1B eligibility criteria?
The EB-1B (Outstanding Professors and Researchers) requires a permanent job offer from a U.S. university or qualifying research institution, plus at least three years of teaching or research experience. You must also show international recognition for your academic contributions, usually through publications, citations, or awards in your field.
What are the EB-1C eligibility criteria?
The EB-1C (Multinational Manager or Executive) is for high-level professionals transferring to a U.S. office of a multinational company. You must have worked abroad for at least one of the past three years in a managerial or executive role, and your U.S. employer must prove it has been operating for at least one year.
Can you self-petition without an employer for EB-1?
Yes, but only under the EB-1A (Extraordinary Ability) subcategory. If you qualify, you can file on your own without a sponsoring employer. EB-1B and EB-1C both require a U.S. employer to file the petition on your behalf.
Does the EB-1 require PERM labor certification?
No. Unlike EB-2 and EB-3 categories (except for Schedule A and NIW), the EB-1 does not require the PERM labor certification process. This makes EB-1 one of the faster and more straightforward employment-based immigration options, since you don’t have to go through the lengthy recruitment stage to prove there are no available U.S. workers.
Can my family members be part of my EB-1 application?
Yes. Your spouse and unmarried children under 21 may be included as derivative beneficiaries. If your EB-1 is approved, they can also receive Green Cards, allowing your whole family to live, work, and study in the U.S.
What do I do if I get an EB-1 RFE?
An RFE (Request for Evidence) means USCIS needs more proof before making a decision. RFEs often ask for stronger documentation of your achievements or clarification on your role. The response deadline is strict, and failing to reply properly can result in denial. Working with a lawyer ensures your response is organized, persuasive, and supported by the right evidence.
What do I do if my EB-1 gets denied?
While a denial is not the result you were looking for, the government allows you to file and try again as many times as you want. A denial does not have a legal impact on your ability to file again unless the denial was due to fraud and other limited exceptional circumstances.
