Pay on Approval.
If you select the Pay on Approval option for your EB-1 or EB-2 NIW petition, then your legal fee is split across three payments — and the final one comes due only if your petition is approved. If it isn’t approved, you will not owe the final payment. There is nothing to claim and nothing to request.

Amounts are set individually in your Engagement Letter. The structure below is the same for every Pay on Approval engagement.

Eligibility
What We Need From You.
Pay on Approval is available on eligible EB-1 and EB-2 NIW engagements. These conditions must be met throughout your case.
- 01Attend every government interview, appointment, and biometrics request, and respond to requests as they come.
- 02Give Manifest only truthful, accurate, and complete information.
- 03Stay current on Payments 1 and 2 and on any expenses owed to Manifest Law.
- 04Keep Manifest as your counsel for any RFE, NOID, or similar government request. You may change counsel — doing so ends the arrangement and makes the final payment due.
- 05Do not withdraw the petition or abandon the case once it has been filed.

Common Questions
Before You Ask.
Manifest must remain your counsel for the response in order for Pay on Approval to continue applying. RFE work is not included in your legal fee and is billed separately at a flat $2,500, no matter how complex or lengthy the RFE. If the petition is then approved, Payment 3 becomes due; if it is denied, it does not.
