Can you work on a K-1 visa?
You can’t work on a K-1 visa right away. Unlike many other U.S. visas, the K-1 by itself does not provide employment authorization. That means its holders must request to legally work in the U.S. separately after entering the country.
For K-1 visa holders, the ability to hold a job becomes possible through an employment authorization document (EAD). This benefit can be requested while under K-1 status, or after marrying your U.S. citizen partner and filing for an adjustment of status.

Why K-1 visa holders cannot work right away
The K-1 is a nonimmigrant visa that allows U.S. citizens to bring their foreign fiancé(e) to their country. Once admitted, K-1 holders have up to 90 days to marry and apply for a Green Card. Therefore, its primary purpose is filing for an adjustment of status — not receiving work authorization.
Many people confuse visa validity, immigration status and work authorization. Remember: Visa validity generally refers to the amount of time a person has to legally enter the U.S. A visa serves as a travel document that allows entry into the U.S. Immigration status refers to the length of time a person is permitted to stay legally in the country. Unless specifically authorized by the status, this does not provide the ability to work. If your visa or status doesn’t provide work authorization, you’ll need approval from USCIS first, which usually comes after filing for an EAD.
When can you legally work after entering on a K-1 visa?
Having a pending adjustment of status application allows K-1 visa holders to also apply for a work permit. As of January 2026, USCIS takes about four to eight months to process an employment authorization application if you already applied for adjustment of status.
Because of the timeline, K-1 visa holders will likely have already married their spouses before they receive their EAD. After marriage, the next step will be applying for an adjustment of status so they can receive their Green Card. But an adjustment of status can take around nine months to over a year to process, so applicants will probably receive their EAD before their Green Card.
Timeline to work authorization on K-1 visa:
- First 90 days after arrival: K-1 visa holder marries their U.S. citizen spouse and applies for EAD and adjustment of status at the same time.
- Within about four to eight months after arrival: USCIS processes EAD application and K-1 visa holder receives EAD
- Within about a year or so after arrival: USCIS processes adjustment of status petition and K-1 visa holder becomes a lawful permanent resident (Green Card holder). Once you have a Green Card, you do not need an additional work permit.
Regardless of the pathway chosen, an EAD can be obtained by filing Form I-765.
Several factors affect the individual wait times for work permit applications. Case complexity, the number of pending petitions, and staffing shortages within USCIS are common reasons why your EAD may take longer to arrive than expected.
What is a work permit?
An employment authorization document, also known as an EAD or work permit, shows that USCIS has given you clearance to work in the U.S. as a foreign national. It is not an immigration status, nor does every visa require you to get it before starting a job.
With a work permit, you can:
- Prove to an U.S. employer that you can legally work for them
- Request a Social Security Number (SSN)
- Use it as a form of photo ID at a TSA checkpoint
An EAD should not be confused for a travel document. While a work permit card can be used to prove your identity for domestic U.S. flights, you cannot rely on it to reenter the country. To do that while your Green Card remains pending, you’d need to obtain an advanced parole document.

When you can actually file Form I-765 depends on which category you’re requesting employment authorization under. A work permit based on a K-1 visa may be requested before marriage and filing Form I-485, while an adjustment of status-based EAD cannot. However, she notes that pathway comes with practical risks. “USCIS processing times for a standalone K-1 EAD often take several months, and by then many applicants have moved on to marriage and filing for an adjustment of status,” she says. “For most cases, it makes more sense to apply for an EAD together with your Green Card.”

Timing could not be more crucial than when you’re on a K-1 visa. It only gives you 90 days to enter the U.S., marry your U.S. citizen partner, and submit a Green Card petition. Each of these steps alone can be extremely complicated, so move fast to avoid any unnecessary delays or lapses in legal status.
