The O-1 is a temporary U.S. work visa for people with a demonstrated record of extraordinary ability. It has no annual cap and no lottery, so you file when your record is ready rather than waiting for a season. Plus, spouses and children under 21 can accompany you as dependents under O-3 status.

• Within the O-1 visa are two subcategories: the O-1A for those in science, business, education, or athletics, and the O-1B covers the arts generally (extraordinary ability) as well as motion picture and television (extraordinary achievement, a higher standard), the same six criteria apply, but the bar for film/TV is set higher.

• Membership in associations that require outstanding achievements
• Published material about you in major media
• Judging the work of others
• Original contributions of major significance
• Authorship of scholarly articles
• A critical or essential role at a distinguished organization
• High salary compared to others in your field.

O-1B (arts, film, TV) applicants must meet at least 3 of these 6 criteria:

• Lead or starring roles in distinguished productions
• Published reviews of your work in major media or trade journals
• Lead/critical roles for organizations with distinguished reputations
• Proven commercial or critical success
• Significant recognition from organizations, agencies, or experts
• High salary or substantial earnings.

Like most work visas, O-1 applicants cannot file their own application. Instead, they must find a petitioner that can submit Form I-129 on their behalf. In most cases, this is a U.S. sponsor or agent.

In Miami, eligible sponsors could include:

• A film, TV, or commercial production company petitioning for you across a specific production schedule
• A music label, management company, or creative agency sponsoring a slate of engagements
• A startup or established tech company in Brickell or Wynwood bringing you on for AI, product, or engineering leadership
• A biotech or life sciences company or research institution, from the University of Miami to the labs of the Boca Raton–Fort Lauderdale corridor, petitioning for you as a lead researcher
• An aerospace manufacturer or supplier in the Homestead area sponsoring a critical engineer on a defined program.

Unlike a traditional employer sponsor, an O-1 agent can consolidate several work contracts or deal memos into a single petition. If you're interested in working for more than one employer or freelancing, this route allows USCIS to review and approve the full scope of your engagements.

Government filing fees for the O-1 generally total a few hundred dollars to just over $1,000, depending on whether the petitioner is a large employer, small business, or nonprofit. Premium processing adds a separate USCIS fee.
