The O-1A works best when you can point to outside evidence that your work stands out — cited papers, talks at recognized conferences, hiring committee or peer review work, press coverage, or a salary at the top of your band. There is no lottery and no country cap, and it is renewable indefinitely.
For engineers with a U.S. employer ready to sponsor. The H-1B is the default sponsored path for engineers with a bachelor’s degree in a related field. Most filings go through the annual March lottery, so timing matters. Cap-exempt employers like universities and some research nonprofits can file year-round.
For engineers moving from a foreign office of the same company. The L-1 works best when you have worked at least one of the past three years at a foreign affiliate, parent, or subsidiary of a U.S. employer. The L-1A is for managers, and the L-1B is for specialized-knowledge engineers. There is no lottery, and dual intent is allowed.
