What is a K-1 fiancé(e) visa?
A K-1 visa allows the fiance of a U.S. citizen to travel to the United States to get married. While it is technically a temporary nonimmigrant visa, its purpose is to help couples start a permanent life together in the U.S.
Once the foreign fiancé(e) enters the U.S. using this visa, the law requires the couple to get married within 90 days. If the wedding doesn’t happen within this window, the fiancé(e) must leave the country.
Getting a K-1 visa involves working with U.S. Citizenship and Immigration Services (USCIS) and the Department of State.
- Step 1: USCIS petition: The U.S. citizen partner starts the process by filing Form I-129F. This form asks the government to recognize the relationship as genuine.
- Step 2: Consular interview: After USCIS approves the petition, it’s sent to a U.S. embassy or consulate in the fiancé(e)’s home country. There, the foreign partner must apply for the visa and attend an in-person interview with a consular officer.
After the marriage takes place, the foreign spouse does not become a permanent resident automatically. They must file a new application called an adjustment of status. This is the process of switching from a temporary fiancé(e) visa to a permanent Green Card.

Factors affecting K-1 visa approval rates
Officials look for specific evidence to make sure a couple is moving to the U.S. for love, not just for a visa. It’s important that your application proves you have a bona fide relationship. This is a legal term that means your relationship is real and sincere. To verify this, officers look for proof that you’ve spent time together and plan to build a life as a married couple.
During the interview and document review, certain red flags can cause an officer to look more closely at your case:
- Large age gaps: If the age difference between partners is much larger than what is common in their culture.
- Language barriers: If the couple doesn’t speak a common language and can’t easily communicate with each other.
- Short timelines: Having a very short courtship or having only met in person one time before filing.
Many K-1 visas are delayed or refused because of paperwork mistakes. Common issues could include:
- Missing signatures: Every required box must be signed.
- Translation issues: All foreign documents must have a certified English translation.
- Outdated forms: A new Form I-129F was introduced in 2025. Using an old version of the form may lead to a rejection.
The country where the fiance lives can also impact the process. In areas with high levels of political unrest or past visa fraud, the government may impose deeper background checks. In some cases, the government may require a visa bond ranging from $5,000 to $15,000 to ensure the visitor follows the rules of their visa.
